This is especially true now that the UK officially left the European Union, and its immigration system has changed.<\/p>\n The\u00a0 previous UK residence card<\/strong>, also known as the EEA biometric residence card (BRC), is\u00a0no longer available to new applicants<\/strong>.\u00b9<\/p>\n Those who already have a BRC card can carry on using it until it expires. However, you can\u2019t use it to prove your right to live or\u00a0work in the UK.\u00b9<\/p>\n The previous UK residence permit has been replaced by a document proving that you have \u2018leave to remain\u2019.<\/p>\n There is\u00a0limited leave to remain<\/strong>, and\u00a0indefinite leave to remain<\/strong>\u00a0– which we\u2019ll look at next.<\/p>\n Limited leave to remain is where you have permission to stay in the UK for a restricted period of time depending on which visa you have. The conditions and time period on your visa will determine how long you can stay, or when you need to apply for a visa extension.<\/p>\n You don\u2019t need to apply separately for limited leave to remain, as\u00a0the permission to stay in the UK is granted when you receive your visa<\/strong>.<\/p>\n There\u2019s also indefinite leave to remain, also known as settlement. This is the option you\u2019ll choose if you want to\u00a0move to the UK\u00a0permanently, and want the right to live, work and study there for as long as you like. It\u2019s also\u00a0the first step to applying for British citizenship<\/strong>.<\/p>\n To be eligible to apply for indefinite leave to remain, you can use one of the following routes:\u00b2<\/p>\n You\u2019ll need to have\u00a0secured a visa first<\/strong>, and remained in the UK for long enough so that you qualify for one of the options above. Then, you can check out the\u00a0different routes to apply for indefinite leave to remain here<\/a>.<\/p>\n There\u2019s also such a thing as a\u00a0biometric residence permit (BRP)\u00a0in the UK. This isn\u2019t to be confused with the EEA biometric residence card (BRC) we mentioned above, as this is no longer open to new applicants.<\/p>\n The biometric residence permit<\/a> (BRP) is issued to you when you\u00a0successfully apply for or extend a visa, or apply to settle in the UK<\/strong>. You don\u2019t need to apply separately for it.<\/p>\n It can be used to confirm your identity, right to study and right to access any benefits or other public services you\u2019re entitled to. However, it\u00a0can\u2019t be used to prove your right to work or rent in the UK<\/strong>.<\/p>\n The BRP will include your personal details, along with your biometric information. This usually means that it\u2019ll feature\u00a0a photo of your face and a copy of your fingerprints<\/strong>. It\u2019ll also have details of your immigration status and whether or not you can access public services like health or benefits. Some BRPs have the holder\u2019s National Insurance (NI) number printed on the back.<\/p>\n There is an application fee to apply for indefinite leave to remain in the UK. You\u2019ll need to pay this on top of any visa fees you may have already paid when you first entered the UK.<\/p>\n To apply for indefinite leave to remain if you have family in the UK, the fee is\u00a0\u00a32,404 per person<\/strong>.<\/p>\n If you\u2019re applying from inside the UK, you may be able to pay extra to get a faster decision (it can take up to 6 months through the standard route). Pay an\u00a0additional \u00a3500<\/strong>\u00a0and you could potentially get a decision on your application\u00a0within 5 working days<\/strong>.\u2075<\/p>\n There\u2019s also the \u2018super priority service\u2019. You\u2019ll need to upload your supporting documents and pay your application fee. Then you\u2019ll need to wait for a decision. Available through the EU Settlement Scheme, this gives you\u00a0leave to continue living in the UK<\/strong>.\u2076<\/p>\n The deadline to apply for settled status was 30th June 2021. However, there are some exceptions to this, allowing people in certain circumstances to still be able to apply.\u2076<\/p>\n For example, if you are from the EU, Switzerland, Norway, Iceland or Liechtenstein, and were living in the UK by 31st December 2020. You must also have reasonable grounds for not applying by the original deadline.<\/p>\n You may also be able to\u00a0apply post-deadline if you have pre-settled status<\/strong>.<\/p>\n It can potentially take\u00a0up to 6 months<\/strong>\u2074 to get a decision on your indefinite leave to remain application. However, if you can afford to pay the additional fee (see above), you could use the super priority service and get a decision by the next working day<\/p>\n If you successfully apply for\u00a0indefinite leave to remain<\/strong>\u00a0in the UK, you can\u00a0stay permanently<\/strong>.<\/p>\n Otherwise, you\u2019ll only have\u00a0limited leave to remain<\/strong>\u00a0and can only stay as long as your\u00a0visa permits<\/a><\/strong>\u00a0(unless you\u2019re able to extend it).<\/p>\n If you want to settle in the UK with your family, you can apply for indefinite leave together.
